Under the applicable federal statute governing Social Security Disability claims or Supplemental Security Income disability claims, in order to be found eligible for benefits, an individual must be found to be "totally disabled" and generally unable to engage in any form of substantial gainful employment for a period of at least twelve consecutive months or more. Typically, these types of claims are handled first at a local Social Security Office but are often denied at that level. Hearings before Administrative Law Judges in Pennsylvania or West Virginia are frequently required in order to obtain these benefits.
