Pennsylvania motorists' claims asre governed by the provisions of the Pennsylvania Motor Vehicle Financial Responsibility Act known as the "Pennsylvania No-Fault Act". Under this statute, an injured party's medical payments and wage loss benefits are paid contractually by the insured's automobile insurance company.
With "Full Tort" coverage, an individual can pursue a claim for pain and suffering and other damages without regard to the seriiousness of the injuries sustained. With "Limited Tort" coverage, an individual must sustain a serious bodily injury in order to pursue a claim for injuries and pain and suffering.
In cases were the other party may have inadequate insurance coverage or n o coverage at all, a person may file an "Underinsured Motorist Claim" or an "Uninsured Motorist Claim" against his or her own automobile insurance company to recover damages for injuries.
